Apple has appealed an ITC ruling regarding a patent dispute over the blood oxygen sensing tech included in both the Series 9 and Ultra 2, allowing the company to temporarily sell both wearables in its online and physical stores. A ruling on the appeal will occur in January 2024.
The original ruling by the International Trade Commission required Apple to pull both models from its online and physical Apple Store locations, though some third-party retailers, like Best Buy and Walmart, were permitted to continue selling any remaining inventory they had.
